Vacant Land Opportunity with a pond in Lower Lake, CA. The incorrect legal property description in the underlying DOT was reviewed. Notwithstanding, the APN number and address were correct. Moreover, the correct legal description was stated in all foreclosure notices and in the Trustee’s Deed Upon Sale (“TDUS”) recorded after the foreclosure on 4/17/19. The TDUS eliminated the underlying DOT. Thus, there is no actual confusion concerning the correct description and property location at 14725 Murphy Springs Road, Lower Lake, CA. Upon prior tender to First American Title Insurance Co. in August 2019, it determined no reason to extend coverage before the foreclosure since there were no challenges to the property or validity of the deed of trust. Neither the borrower or anyone else has challenged or submitted any adverse claim regarding the prior foreclosure or the property description issue to date. It was previously advised on 4/11/24 that REO can proceed with marketing land.
